Employer representatives are invited to attend a no-cost, informative webinar on employee benefits taking place November 21, 2023, from 10:00AM-11:30AM Central, and co-sponsored by the U.S. Employment Opportunity Commission (EEOC) and the Employee Benefits Security Administration (EBSA), U.S. Dept. of Labor.

Our agency experts will discuss employer benefits responsibilities under federal labor and employment laws and identify pitfalls to avoid:

  • EEOC: Our program kicks off with an overview about the federal EEO laws that require that all employee benefits be provided in a non-discriminatory manner unless a statutory exception provides otherwise. Benefits issues will typically be whether the different treatment was based on a protected classification or had the effect of discriminating, and whether the employer has a defense for that discrimination.
     
  • EBSA: The costs of COBRA coverage noncompliance for employers can be quite high. The U.S. Dept. of Labor can assess ERISA fines of up to $110 per qualified beneficiary, per day for noncompliance. Employers may also be subject to COBRA excise taxes assessed by the IRS, as well as damages and court fees that may be awarded to a plaintiff in the event of a lawsuit. This presentation will assist employers in avoiding the pitfalls of COBRA compliance.
