On December 19, 2024, the Department of Homeland Security (DHS) published its Final Rule, Modernizing H2 Program Requirements, Oversight and Worker Protections. This pertains to H-2A and H-2B users. This latest round of rulemaking parallels some of the protections the Department of Labor published in June 2024, increasing provisions to ensure H2 workers are not exploited and holding employers and service providers accountable for that exploitation. However, the rules also contain some beneficial changes that clarify H2 employee lengths of stay, reduce burdens when workers change their temporary status, and streamline the H2 programs. These new rules go into effect on Jan. 18, 2025.

Presenters: Enrique Gastelum, CEO, and Ryan Ogburn, Visa Services Director, will walk attendees through the new DHS rules, discuss ideas to prepare for complying with the rules and give best practices for managing situations that may arise and create necessary actions by the employer.
